Welcome to Hawaii Supply Co. ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of hawaiisupplyco.com, including any content, functionality, and services offered on or through the site (the "Site"). By accessing or using the Site, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Changes to These Terms

We may update these Terms from time to time. Changes take effect once posted to this page, and the "Last updated" date above will be revised. Your continued use of the Site after changes are posted means you accept the updated Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on the Site. By using the Site, you represent that you meet this requirement.

3. Products, Pricing & Availability

We attempt to display product details, images, and pricing as accurately as possible, but we do not warrant that product descriptions or other content are error-free. Prices and availability are subject to change without notice. We reserve the right to limit quantities, refuse or cancel orders, and correct pricing errors, including after an order has been submitted or confirmed.

Sealed trading card products (booster boxes and packs) contain randomized contents. We make no guarantee of the contents, pull rates, or market value of any cards inside sealed product. Card values fluctuate and are not grounds for a refund.

Hawaii Supply Co. is an independent retailer and is not affiliated with, endorsed by, or sponsored by Nintendo, Creatures Inc., GAME FREAK inc., or The Pokémon Company International. All trademarks are the property of their respective owners.

4. Orders & Payment

By placing an order, you are making an offer to purchase the selected products subject to these Terms. We reserve the right to accept or decline any order for any reason, including suspected fraud, errors in pricing or product information, or issues with payment. Payment must be made in full through one of our accepted payment methods at checkout. You represent that any payment information you provide is accurate and that you are authorized to use the payment method submitted.

5. Shipping & Delivery

Orders ship from Honolulu, Hawaii, and orders over $225 qualify for free shipping. Shipping times and costs are estimates only and are not guaranteed. Risk of loss and title for products pass to you upon our delivery to the shipping carrier. We are not responsible for delays caused by carriers, customs, weather, or other events outside our reasonable control.

6. Returns & Refunds — All Sales Final Important

Because we sell collectibles, all sales are final. We do not accept returns or exchanges, including for sealed product or single cards. If your order arrives damaged, defective, or incorrect, contact us within 7 days of delivery with your order number and photos and we will replace the item or issue a refund.

7. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use of your account.

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Hawaii Supply Co. or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

9. Prohibited Uses

You agree not to use the Site to: violate any applicable law or regulation; infringe the rights of others; transmit harmful code or malware; attempt to gain unauthorized access to the Site or its related systems; scrape or harvest data without permission; or interfere with the proper functioning of the Site.

10. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, policies, or practices of any third-party sites.

11. Disclaimer of Warranties

The Site and all products are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

12. Limitation of Liability

To the fullest extent permitted by law, Hawaii Supply Co. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products purchased through it, including changes in the market value of cards. Our total liability for any claim arising out of these Terms or your use of the Site shall not exceed the amount you paid for the product(s) giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Hawaii Supply Co., its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Site or violation of these Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Hawaii, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Hawaii, and you consent to personal jurisdiction in those courts.

15. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
